Pendahuluan
Istilah satir “klasemen Liga Korupsi Indonesia” tiba-tiba populer dijagat maya dan juga banyak diberitakan dimedia-media nasional, istilah ini muncul dan akhirnya popoler atau viral setelah terbongkarnya kasus korupsi yang melibatkan pejabat tingkat atas PT Pertamina Patra Niaga, istilah klasemen ini biasanya digunakan dalam dunia olah raga seperti sepak bola untuk menunjukan peringkat klub dalam suatu liga atau kompetisi. Bedanya klasmen liga korupsi Indonesia menujukan urutan kasus korupsi dengan kerugian Negara tersbesar.
Posisi paling puncak periode 2025 klasemen liga korupsi Indonesia ditempati oleh PT Pertamina Patra Niaga pada kasus korupsi tata kelola minyak mentah dan produk kilang pada 2018-2023, negara mengalami kerugian Rp968,5 triliun atau hampir 1 kuadriliun. Posisi kedua ditempati kasus korupsi tata niaga timah di wilayah izin usaha pertambangan (IUP) PT Timah Tbk periode 2015-2022. Kejaksaan Agung (Kejagung) bersama Badan Pemeriksa Keuangan (BPK) mencatat kerugian negara atas kasus dugaan korupsi ini pada periode 2015-2022 mencapai Rp300 triliun. (SindoNews/15 Maret 2025)
Selain kedua kasus korupsi besar tersebut diatas masih banyak rentetan kasus korupsi yang masuk pada daftar klasemen Liga Korupsi Indonesia seperti kasus BLBI dimana Negara mengalami kerugian Rp 138,44 Triliun, korupsi PT Duta Palma yang menyebabkan kerugian Negara sebesar Rp 78 Triliun, korupsi PT PTPI menyebabkan kerugian negara sebesar Rp. 37.8 Trililun, korupsi PT ASABRI menyebabkan kerugian Negara sebesar 22,7 Triliun.
Kasus korupsi di Indonesia telah menjadi permasalahan yang sepertinya tidak tampak ujung penyelesaianya, dari tahun ke tahun semakin banyak bahkan dengan tingkat kerugian yang ditanggung Negara semakin luar biasa besarnya, Wakil Ketua KPK 2019-2024, Alexander Marwata, saat Konferensi Pers Capaian Kinerja KPK Periode 2019-2024 di Jakarta menyampaikan data mengenai penanganan perkara periode 2020-2024. Selama 5 tahun, KPK mencatat telah melakukan penyelidikan (541 perkara); penyidikan (622 perkara); penuntutan (510 perkara); perkara yang berkekuatan hukum tetap/inkracht (533 perkara;) dan pelaksanaan eksekusi (524 perkara).
Dengan jumlah tersebut, selama kurun 2020-2024 KPK telah menetapkan tersangka sebanyak 691 tersangka, dengan 36 kali kegiatan tangkap tangan dan 29 perkara TPPU. KPK pun telah menetapkan sejumlah korporasi sebagai tersangka, yakni sebanyak 6 korporasi,” (KPK.go,id 2024).
berdasarkan Indeks Persepsi Korupsi (IPK) 2023, Indonesia berada di peringkat 115 dari 180 negara dengan skor 34 dari 100. Skor ini lebih rendah dari rata-rata global, yaitu 43.
Berdasarkan paparan diatas, ada dual hal yang akan dibahas pada makalah ini yaitu, apa penyebab mendasar kasus-kasus korupsi yang telah manjadi penyakit kronis bangsa ini? Dan bagaimana ?
Pengertian Korupsi
Kata korupsi berasal dari bahasa latin corruptio atau corruptus. Corruptio memiliki arti beragam yakni tindakan merusak atau menghancurkan. Corruptio juga diartikan kebusukan, keburukan, kebejatan, ketidakjujuran, dapat disuap, tidak bermoral, penyimpangan dari kesucian, kata-kata atau ucapan yang menghina atau memfitnah. Kata corruptio masuk dalam bahasa Inggris menjadi kata corruption atau dalam bahasa Belanda menjadi corruptie. Kata corruptie dalam bahasa Belanda masuk ke dalam perbendaharaan Indonesia menjadi korupsi. Menurut Kamus Besar Bahasa Indonesia (KBBI), korupsi adalah penyelewengan atau penyalahgunaan uang negara (perusahaan, organisasi, yayasan, dan sebagainya) untuk keuntungan pribadi atau orang lain.
Definisi lainnya dari korupsi disampaikan World Bank pada tahun 2000, yaitu “korupsi adalah penyalahgunaan kekuasaan publik untuk keuntungan pribadi”. Definisi World Bank ini menjadi standar internasional dalam merumuskan korupsi.
Pengertian korupsi juga disampaikan oleh Asian Development Bank (ADB), yaitu kegiatan yang melibatkan perilaku tidak pantas dan melawan hukum dari pegawai sektor publik dan swasta untuk memperkaya diri sendiri dan orang-orang terdekat mereka. Orang-orang ini, lanjut pengertian ADB, juga membujuk orang lain untuk melakukan hal-hal tersebut dengan menyalahgunakan jabatan.
Indonesia sendiri melalui UU No. 31 Tahun 1999 yang telah diubah dengan UU No. 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi telah mengelompokkan korupsi ke dalam 7 jenis utama. Ketujuh jenis tersebut adalah kerugian keuangan negara, suap-menyuap, penggelapan dalam jabatan, pemerasan, perbuatan curang, benturan kepentingan dalam pengadaan, dan gratifikasi. Adapun menurut fatwa MUI tahun 2000 tentang korupsi, korupsi didefinisikan tindakan pengambilan sesuatu yang ada dibawah kekuasaannya dengan cara yang tidak benar menurut syariat Islam.
Dari berbagai pengertian di atas, korupsi pada dasarnya memiliki lima komponen, yaitu:
(1) Korupsi adalah suatu perilaku. (2) Ada penyalahgunaan wewenang dan kekuasaan. (3) Dilakukan untuk mendapatkan keuntungan pribadi atau kelompok. (4) Melanggar hukum atau menyimpang dari norma dan moral.(5) Terjadi atau dilakukan di lembaga pemerintah atau swasta.
Faktor Penyebab Korupsi
Dalam buku Pendidikan Anti korupsi untuk Perguruan Tinggi yang diterbitkan kemenristekdikti 2018, ada dua faktor penyebab seseorang melakukan korupsi yaitu faktor internal dan eksternal. faktor internal merupakan penyebab korupsi dari diri pribadi, sedang faktor eksternal karena sebab-sebab dari luar.
Faktor Penyebab Internal diantaranya Sifat serakah/tamak/rakus manusia, Gaya hidup konsumtif, Moral yang lemah. Adapun faktor penyebab eksternal diantaranya :
- Aspek Sosial : Kehidupan sosial seseorang berpengaruh dalam mendorong terjadinya korupsi, terutama keluarga. Bukannya mengingatkan atau memberi hukuman, keluarga malah justru mendukung seseorang korupsi untuk memenuhi keserakahan mereka.
- Aspek Politik : Keyakinan bahwa politik untuk memperoleh keuntungan yang besar menjadi faktor eksternal penyebab korupsi. Tujuan politik untuk memperkaya diri pada akhirnya menciptakan money politics. Dengan money politics, seseorang bisa memenangkan kontestasi dengan membeli suara atau menyogok para pemilih atau anggota-anggota partai politiknya.
- Aspek Hukum : Hukum sebagai faktor penyebab korupsi bisa dilihat dari dua sisi, sisi perundang-undangan dan lemahnya penegakan hukum. Koruptor akan mencari celah di perundang-undangan untuk bisa melakukan aksinya. Selain itu, penegakan hukum yang tidak bisa menimbulkan efek jera akan membuat koruptor semakin berani dan korupsi terus terjadi.
- Aspek Ekonomi : Faktor ekonomi sering dianggap sebagai penyebab utama korupsi. Di antaranya tingkat pendapatan atau gaji yang tak cukup untuk memenuhi kebutuhan.
- Aspek Organisasi : Biasanya, organisasi ini memberi andil terjadinya korupsi, karena membuka peluang atau kesempatan. Misalnya tidak adanya teladan integritas dari pemimpin, kultur yang benar, kurang memadainya sistem akuntabilitas, atau lemahnya sistem pengendalian manajemen.
Analisis faktor penyebab korupsi tersebut tentunya belum bisa dikatakan mendalam karena masih ada faktor mendasar lainnya yang mendukung faktor-faktor tersebut dapat tumbuh subur, Faktor paling mendasar penyebab korupsi sebenarnya berpangkal dari ideologi yang ada, yaitu demokrasi-kapitalis. Faktor ideologis inilah, beserta beberapa faktor lainnya, menjadi penyebab dan penyubur korupsi saat ini. Faktor ideologis tersebut terwujud dalam nilai-nilai yang menjadi anutan dalam masyarakat kini yang berkiblat kepada Barat, seperti nilai kebebasan dan hedonisme. Demokrasi-kapitalis telah mengajarkan empat kebebasan yang sangat destruktif, yaitu kebebasan beragama (hurriyah al aqidah), kebebasan kepemilikan (hurriyah al tamalluk), kebebasan berpendapat (hurriyah al ra`yi), dan kebebasan berperilaku (al hurriyah al syakhshiyyah). Empat macam kebebasan inilah yang tumbuh subur dalam sistem demokrasi-kapitalis yang terbukti telah melahirkan berbagai kerusakan. Korupsi merupakan salah satu kerusakan akibat paham kebebasan kepemilikan (hurriyah al tamalluk) tersebut. (Abdul Qadim Zallum, Ad Dimuqrathiyah Nizham Kufr, 1990).
Selain itu kapitalisme menggunakan sistem pemerintahan berdasarkan demokrasi yang konsep dasarnya kedaulatan ada di tangan manusia, termasuk kedaulatan hukum, Sehingga para penguasa yang mengatasnamakan rakyat bisa mengotak-atik hukum yang dibuat sesuai kepentingan. dalam praktiknya, sistem demokrasi juga adalah sistem politik yang berbiaya tinggi. Membengkaknya biaya politik kemudian mendorong kandidat untuk mencari sumber pendanaan lain. Fenomena ini ditambah dengan profesionalisasi kegiatan politik seperti biaya kampanye, polling, iklan di media massa, hingga konsultan politik, yang kesemuanya perlu pembiayaan (Falguera et.al., 2014) Di sinilah letak peluang korupsi itu. Sistem demokrasi meniscayakan membuka peluang para oligarki memodali pemilihan wakil rakyat dan pejabat. Sehingga siapapun yang jadi pemimpin pasti akan tunduk pada pemilik modal.
Praktik seperti ini membuat negara lemah di hadapan oleh oligarki. Kebijakan-kebijakan negara dibuat untuk menguntungkan pemilik modal. Sementara pejabat negara memanfaatkan kekuasaannya untuk mengembalikan modal dengan segala cara, termasuk korupsi. Alhasil lagi-lagi rakyat menjadi korban.
Cara Islam Memberantas Korupsi
Kasus korupsi yang terus menggurita dinegeri ini hanya bisa tuntas diselesaikan kalau faktor mendasar yang penyebab korupsi dihilangkan, dan hanya dengan sistem pemerintahan Islam yang sangat berbeda dengan sistem pemerintahan demokrasi, faktor mendasar penyebab korupsi dalapat dihilangkan. sistem Islam pernah diterapkan selama lebih dari 13 abad, Telah terbukti bahwa dalam urusan pemberantasan korupsi, Islam melalui institusi negara mampu menutup rapat-rapat celah korupsi bahkan memungkinkan korupsi menjadi nol. Hal tersebut diawali dari mekanisme sistem politik Islam itu sendiri, tidak mahal dan sangat sederhana. Kekosongan posisi khalifah (pemimpin negara Islam) maksimal 3 hari 3 malam. Sehingga dalam rentang waktu tersebut, kaum muslimin harus melakukan pemilihan dan pembaiatan khalifah.
Kepemimpinan Islam bersifat tunggal. Adapun pengangkatan dan pencopotan pejabat negara menjadi kewenangan khalifah. Konsep politik seperti ini tidak akan memunculkan persekongkolan mengembalikan modal dan keuntungan kepada cukong politik. Inilah yang mencegah adanya praktek korupsi. Kemudian dalam urusan rekrutmen pegawai negara, kualifikasi wajib berdasarkan profesionalitas dan integritas. Bukan berasaskan koneksi, nepotisme, atau praktik balas budi. Para pegawai negara wajib berkapabilitas dan berkepribadian Islam (syahsiyah islamiyah). Sebab nabi SAW pernah bersabda, “Jika urusan diserahkan kepada yang bukan ahlinya, maka tunggulah hari kiamat.” (HR. Bukhari).
Sementara untuk mendapatkan kualifikasi pegawai yang demikian, khilafah menerapkan sistem pendidikan Islam yang targetnya membentuk generasi bersakhsiyah islamiyah. Sebagaimana yang dijelaskan dalam kitab Usus at-Ta’lim al-Manhaji fi Daulah al-Khilafah karya Syekh ‘Atha bin Khalil, Amir Hizbut Tahrir.
Pola pikir (aqliyah) dan pola sikap (nafsiah) masyarakat diarahkan agar berlandaskan kepada syariat Islam. Dengan demikian, generasi akan berkemampuan untuk mengendalikan diri agar menjauhi kemaksiatan. Kemaksiatan yang dimaksud di antaranya adalah tidak amanah dalam jabatan, melakukan korupsi, dan sebagainya. Islam juga mengatur urusan pembayaran pegawai. Negara wajib memberikan gaji dan fasilitas yang layak sebagaimana perintah dari Rasulullah SAW dalam sabdanya, “Siapa saja yang bekerja untuk kami tapi tak punya rumah, hendaklah dia mengambil rumah. Jika tak punya istri, hendaklah ia menikah. Jika tak punya pembantu atau kendaraan, hendaklah ia mengambil pembantu atau kendaraan.” (HR. Ahmad).
Hal senada juga disampaikan oleh Abu Ubaidah kepada Umar. “Cukupilah para pegawaimu agar mereka tidak berkhianat.” Di sisi lain, sistem Islam juga menetapkan kebijakan bahwa haram hukumnya bila para pegawai negara menerima suap dan hadiah. Hal ini berdasarkan perintah rasul dalam hadis nabi SAW, “Hadiah yang diberikan kepada para penguasa adalah haram, dan suap yang diterima hakim adalah kekufuran.” (HR. Ahmad).
Sistem Islam pun bisa menelusuri pegawainya agar tidak terlibat tindak korupsi. Sebab negara memiliki kebijakan yang unik, yakni akan melakukan perhitungan kekayaan bagi para pegawai negara di awal dan diakhir jabatannya. Kemudian akan melakukan pembuktian terbalik jika ditemukan penambahan harta yang tidak wajar.
Sebagai pamungkas, jika masih saja ada pegawai yang korup, maka negara akan memberi sanksi Islam (‘uqubat). Syekh Abdurrahman Al Maliki dalam kitabnya Nizhamul ‘Uqubat menjelaskan bahwa hukuman untuk koruptor masuk kategori takzir. Yaitu hukuman yang jenis dan kadarnya ditentukan oleh hakim.
Bentuk takzir ini dimulai dari yang paling ringan, seperti nasehat atau teguran. Sampai yang paling tegas, yaitu hukuman mati. Kadar hukuman disesuaikan dengan berat-ringannya kejahatan. ‘Uqubat bersifat jawabir (penebus dosa) bagi pelaku. Juga zawajir (pencegah) agar masyarakat tidak melakukan hal yang sama. Sementara harta hasil korupsi akan menjadi harta ghulul. Harta ini akan diambil negara dan dimasukkan ke dalam pos kepemilikan negara di Baitul mal.
Namun, sebelum korupsi bisa terjadi, pola pendidikan Islam akan melahirkan insan-insan yang berkepribadian Islami (syakhsiyah Islamiah). Hal ini menciptakan lingkungan yang kondusif agar rakyat senantiasa berbuat baik. Ada kontrol masyarakat yang akan senantiasa melakukan amar makruf nahi mungkar. Sehingga tidak ada sedikit pun tercipta celah keculasan di entitas masyarakat.
Seperti inilah solusi syar’i yang seharusnya diambil jika memang benar-benar ingin memberantas korupsi dengan tuntas. Solusi yang berasal dari Sang Pencipta yang Maha Pengatur, yang telah diterapkan dan terbukti keberhasilannya selama hampir 14 abad. Wallahu a’lam bishshawab [Rangga]
